How each process works

Arbitration.

A private process in which an arbitrator, rather than a court, determines the dispute.

Mediation.

A facilitated negotiation, in which a mediator helps the parties discuss a resolution rather than deciding the dispute.

Negotiation.

Direct discussion between the parties or their lawyers, which may occur at any stage of a dispute.

If your contract requires it

Some contracts provide for arbitration or mediation before court proceedings are started. If yours does, we will talk you through what that means for your matter.

Confidentiality

Arbitration and mediation are generally conducted privately. We can explain how confidentiality would work in your matter.
